SITE OPERATION

1.  United Arab Emirates is our Country of Domicile. Innovative Hiring controls this Site from the U.A.E. Innovative Hiring makes no representation that this Site is appropriate for use in other locations. If you use this Site from other locations you are responsible for ensuring compliance with local laws. You may not use, export or re-export any materials from this Site in violation of any applicable laws or regulations, including, but not limited to any U.A.E export laws and regulations.

APPLICABLE LAW

2.  The Laws of the United Arab Emirates shall govern the use of the Site and the Terms of Use, without regards to conflict of laws principals. All disputes arising in connection therewith shall be heard only by a court of competent jurisdiction in U.A.E.

PURCHASES

3.  Innovative Hiring accepts payment by Visa or Mastercard debit and credit cards in AED for its products and services. All online purchases are also governed by the terms and conditions of respective merchant service providers. Please review respective merchant service provider’s user agreement and privacy policy before entering any transaction. Interpretation. These Terms of Use supersede all other written and oral communications or agreements with regard to the subject matters discussed in these Terms of Use. A waiver or modification of these Terms of Use will only be effective if made in writing signed by an authorized officer of Innovative Hiring. All refunds will be made onto the original mode of payment.

FEES and CHARGES

4.  Amount quoted is for one use of the Equipment only – for the noted hiring term. Any additional cost for hire loss, hire extension, damage and repair will be charged to and payable by the Hirer.

5. Damage Waiver is payable by the Hirer to cover all costs associated with normal wear and tear to the Equipment and any accidental damage to a particular item of Equipment, provided that the replacement cost and/or cost of repairs to any Equipment which was damaged does not exceed 10% of the hiring fee for the particular item.
    
This waiver does not apply to any other damage to Equipment including;
(a) damage resulting from overloading, exceeding rated capacity, misuse, abuse or improper servicing of Equipment;
(b) damage due to mysterious disappearance of the Equipment;
(c) damage caused by the use or operation of Equipment in contravention of any of the conditions of the Agreement;
(d) damage to, or loss of, the Equipment from any unknown cause.

6.  All prices quoted are in dirham (AED).

7. A 50% non refundable deposit is required at point of booking; full payment must be made min. of 48 hours prior to delivery.

8. Any additions or amendments to the order will be payable immediately after the event.

10. Cancellation of orders will forfeit all booking deposits. Cancellations made within 48 hours of delivery will incur a 100% cancellation fee.

LIABILITY and INDEMNITY

11. The Hirer is responsible for the Equipment from the time of delivery until collection by the Owner and shall pay for all Equipment damage or lost however caused during that period. The Hirer shall maintain at its expense liability, property and casualty insurance coverage in amount necessary to fully protect the Owner and its Equipment against all claims, loss or damage of whatever nature or type. The Owner shall not be liable for any loss or damage caused to any person, property, animal or things whatsoever arising from the use of the Equipment hereby hired and the Hirer indemnifies the Owner in respect to any claims for such loss or damage.

12. The Owner’s count and/or decision as to condition of the Equipment prior to dispatch and on return shall be final.

13. The Hirer shall not remove the Hire Equipment or any part thereof from the situation and position of its installation without consent from the Owner. The Hirer grants the Owner access at all times to inspect or repair the Equipment and in the case of default to remove the Equipment. The Hirer shall on no account attempt to repair the Equipment but notify the Owner immediately in case of breakdown or failure.

14. The person signing the documents for and on behalf of the Hirer hereby covenants with the Owner that he or she has the authority of the Hirer to make this agreement on the Hirer’s behalf and is empowered by the Hirer to bind the Hirer to this agreements and hereby indemnifies the Owner against all losses and cost incurred by the Owner arising out of the person signing this agreement failing to have such power and/or authority.

15. The owner reserves the right to take photos at event locations utilising the Owner’s equipment. Photos are taken with a focus on the Equipment and are selected with due care to exclude recognizable private property and persons. Photos may be used in publications or other media material produced, used, or contracted by the Owner.

OFFICE FOREIGN ASSETS CONTROL (OFAC) SANCTIONED COUNTRIES

16.  Innovative Hiring will not trade with or provide any services to individuals and companies owned or controlled by, or acting for or on behalf of, OFAC targeted countries AND individuals, groups, and entities, such as terrorists and narcotics traffickers designated under the OFAC programs that are not country specific.

REPRESENTATIONS BY YOU

17.  By visiting the Site, you represent, warrant and covenant that (a) you are at least 18 years old; (b) that all materials of any kind submitted by you to Innovative Hiring through the Site or for inclusion on the Site will not plagiarize, violate or infringe upon the rights of any third-party including trade secret, copyright, trademark, trade dress, privacy, patent, or other personal or proprietary rights. The customer using the website who are Minor /under the age of 18 shall not register as a User of the website and shall not transact on or use the website.

PERMITTED USE

18.  You agree that you are only authorized to visit, view and to retain a copy of pages of this Site for your own personal use, that you shall not duplicate, download, publish, modify or otherwise distribute the material on this Site for any purpose other than for personal use, unless otherwise specifically authorized by Innovative Hiring to do so. You also agree not to deep-link to the site for any purpose, unless specifically authorized by Innovative Hiring to do so. The content and software on this Site is the property of Innovative Hiring. The cardholder must retain a copy of transaction records and Merchant policies and rules.

YOUR ACCOUNT

19.  If you use Innovative Hiring Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your account from any devices, and you agree to accept responsibility for all activities that occur under your account or password. The Site shall not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with, your failure to comply with this section.
